Mandatory vaccinations and penalties — do parents still have a choice?

Sources: 11 · Article: 10 265 characters

Jerzy Jaśkowski believes that a doctor who forces vaccination is acting unprofessionally and in a morally questionable way.

  • The STOP NOP Association says that parents can refuse consent and that a doctor cannot administer a vaccine on their own authority.
  • The ruling cited describes vaccination against tuberculosis and hepatitis B as mandatory up to the ages of 15 and 19, respectively.
  • Refusing vaccination in hospital may, but does not have to, lead to enforcement proceedings; in some countries, opposition may bring fines, problems enrolling in public school, or even criminal proceedings.

In some countries, opposing vaccination may bring fines, problems enrolling in public school, or even criminal proceedings.

„These may include fines or even problems enrolling in public schools. In some cases, parents may even risk criminal proceedings, as happened recently in France, where two parents who refused to have their children vaccinated risked being sentenced to prison.”Mogą to być kary pieniężne lub nawet problem z przyjęciem do publicznych szkół. W niektórych przypadkach rodzice mogą nawet ryzykować wszczęcie przeciwko nim postępowania karnego tak, jak ostatnio miało to miejsce we Francji, gdzie dwoje rodziców, którzy odmówili szczepienia swoich dzieci ryzykowało wyrokiem skazującym na więzienie.

Refusing vaccination in hospital may, but does not have to, lead to proceedings to enforce vaccination.

„Refusing consent to vaccination and/or other medical procedures in hospital may, but does not have to, result in the case being referred to the sanitary inspectorate and proceedings being initiated to enforce vaccination. If this happens, you can seek support from STOP NOP by sending a text message to 606668891.”Odmowa zgody na szczepienia lub/i inne zabiegi medyczne w szpitalu może, ale nie musi spowodować przekazanie sprawy do sanepidu i wszczęcie postępowania przymuszającego do szczepień. The ruling cited describes vaccination against tuberculosis and hepatitis B as mandatory until the ages of 15 and 19, respectively.

„(?) It should be noted that in Poland, vaccination against tuberculosis is mandatory until age 15, and vaccination against hepatitis B until age 19. Participants can therefore vaccinate the child once they are sure that their minor daughter has sufficient immunity.”(?)

Parents can refuse consent to vaccinating their child, and medical staff should obtain consent for every medical intervention.

„From the moment a newborn is born, the parents are the child's legal representatives, and medical staff have a duty to inform them about everything concerning their newborn and to ask their consent for every medical intervention, including vaccination.”Rodzice noworodka od chwili narodzin są jego przedstawicielami ustawowymi, a na personelu medycznym spoczywa obowiązek informowania ich o wszystkim, co dotyczy ich nowo narodzonego dziecka, a także pytanie rodziców o zgodę na każdą interwencję medyczną również szczepienie.

The legal opinion cited says that a doctor cannot administer a vaccine on their own authority or force a parent to allow the procedure.

„Incidence of diphtheria (source: Statistisches Bundesamt Wiesbaden) Under Polish law, a doctor cannot administer a vaccine on their own authority or force a parent to allow a procedure. This rule also applies when a newborn is vaccinated in hospital.”Zachorowalność na błonicę (źródło: Statistisches Bundesamt Wiesbaden) Zgodnie z polskim prawodawstwem, lekarz nie może samowolnie podać szczepionki ani zmusić rodzica, aby ten umożliwił wykonanie zabiegów. Zasada ta obowiązuje także w czasie szczepienia noworodka w szpitalu.

Parents are not legally required to sign documents or declarations at a hospital, clinic, or sanitary inspectorate.

„Parents are not legally required to sign any documents or declarations, whether at a hospital, clinic, or sanitary inspectorate. If staff put strong pressure on you to sign a document they have presented, write: “I refuse to sign this declaration,” add your signature, and attach your own declaration.5.”Rodzic nie ma obowiązku prawnego podpisywania jakichkolwiek dokumentów czy oświadczeń – czy to w szpitalu, czy w przychodni, czy w sanepidzie. W razie dużej presji na podsuwanym przez personel oświadczeniu należy napisać: „Odmawiam podpisania tego oświadczenia”, złożyć podpisy oraz załączyć swoje oświadczenie.5.

Jerzy Jaśkowski describes a doctor who forces vaccination as acting unprofessionally and in a morally questionable way.

„“A doctor who continues to force vaccination is acting unprofessionally and in a morally questionable way because they misrepresent the facts and conceal negative consequences.” It is worth starting with the fact that no vaccine is a biological preparation; it is a chemical one.”„Lekarz, który nadal wymusza szczepienia, postępuje błędnie zawodowo i wątpliwie moralnie, ponieważ fałszywie przedstawia fakty i ukrywa negatywne konsekwencje”. Warto zacząć od tego, że żadna szczepionka nie jest preparatem biologicznym, tylko chemicznym.

The STOP NOP Association describes vaccination as being forced across Europe.

„Vaccine safety is very important to people who want to be vaccinated or want their children to be vaccinated, especially now that vaccination is being forced across Europe. To this day, few studies can confirm the safety of vaccination. (str.

The review indicates that mandatory vaccination may increase vaccination rates, although it can provoke opposition among some parents.

Aim of the study: Uptake of childhood vaccines is decreasing. While mandatory vaccination schemes can increase vaccine uptake rates, they can also cause backlash among some parents.

Results: Qualitative studies gave an insight into how parents perceive mandatory vaccination. Studies found that parents perceived mandatory vaccination schemes as an infringement of their rights, and particularly disliked schemes offering financial incentives for vaccination. Nevertheless, some parents felt that schemes limiting access to schooling of unvaccinated children gave them "peace of mind." Results should be taken with caution due to the purposive use of non-representative samples. Before deciding to mandate vaccination, it is important to understand the impact it could have on parental beliefs and attitudes about vaccination.

Experts say that where vaccination rates are low or disease outbreaks occur, mandatory vaccination may save children's lives.

Aim of the study: Vaccinating children is amongst the most cost-effective interventions for reducing children's morbidity and mortality. Parents who choose not to vaccinate their children despite having been informed about the evidence on safety and efficacy of vaccines may seriously jeopardise the health of both their own children and others.

Results: Forcing parents is of course not the only solution to counteracting the fear of vaccines. Health authorities should certainly fund research and deploy resources on combatting vaccine disinformation. Conclusion: It would be preferable to achieve high rates of vaccination coverage by educating both parents and physicians without adopting any legislation for mandatory vaccination. However, in countries where vaccination uptake is low and/or outbreaks of vaccine-preventable diseases occur, the implementation of mandatory vaccination will most probably save children's lives. EAP calls for action to make all scheduled childhood vaccinations a matter of fact for all European children.

„It is not uncommon for parents of both vaccinated and unvaccinated children, to diagnose the cough before the doctor does, and after the doctor has misdiagnosed and mis-prescribed multiple times. The doctor surprisingly continues to deny parents the right to get their child tested. Often, when this happens, the parents will go to another facility and get the test, which comes back positive. As the cough becomes more severe, various stimuli can trigger it. A classic way of diagnosis is to touch the middle of the tongue with your finger to see if this starts the cough.”It is not uncommon for parents of both vaccinated and unvaccinated children, to diagnose the cough before the doctor does, and after the doctor has misdiagnosed and mis-prescribed multiple times.
