Terms of Service
Pisaczek · Version of 5 October 2026
This document is shown in English. The Polish version is binding.
§ 1. General provisions
- These Terms set out the rules for using the Pisaczek service available at app.pisaczek.pl, in the app installed from the browser (on phones, tablets and computers) and in the Pisaczek app for Windows (“Pisaczek”).
- The service provider is: Robert Brzoza, 250 Prospect Ave, Meriden, CT 06451, USA.
- Contact: e-mail kontakt@pisaczek.pl.
- These Terms are terms for the provision of electronic services under the Polish Act of 18 July 2002 on the provision of electronic services. They are available free of charge in a form that allows downloading, saving and printing.
- Definitions: User – a person using Pisaczek; Account – the User’s individual password-protected account; Plan – the set of features and limits assigned to the Account (e.g. Free); User Content – any data, files, notes and other materials the User places in Pisaczek; Consumer – a natural person concluding a contract not directly related to their business or profession.
§ 2. Scope of services
- The provider offers in particular: the Account, storing and organising notes and files, a calendar and appointment booking, a content editor, search, chat and – in Plans that include them – artificial intelligence tools (including the Assistant) and messaging tools.
- The Free Plan is free of charge and includes the features and limits described in Pisaczek (including file storage of up to 100 MB). The Free Plan may change as described in § 11.
- Paid Plans and add-ons (e.g. AI Tokens) will be sold under separate terms of sale and a price list made available before purchase. These Terms do not oblige the User to make any payment.
- Pisaczek can also be browsed without an Account, to a limited extent (guest mode).
§ 3. Technical requirements
- To use Pisaczek you need a device with internet access, an up-to-date browser (Chrome, Edge, Firefox or Safari) with JavaScript and cookies enabled, and an active e-mail address. The Windows app requires Windows 10 or 11.
- Using electronic services involves specific risks such as malware, password interception or phishing. We recommend a strong password, enabling two-factor sign-in (2FA) and never sharing sign-in details.
§ 4. Account – conclusion and termination
- The contract for the Account is concluded when the Account is created after accepting these Terms. It is concluded for an indefinite period.
- An Account may be created by a person aged at least 16. A legal person or organisation acts through an authorised person.
- The User provides a genuine e-mail address and keeps the password and two-factor codes confidential.
- The User may terminate the contract at any time without giving reasons: with the “Delete account” button in the Account settings, or by sending a request to delete the Account from the Account’s e-mail address to kontakt@pisaczek.pl. The Account is closed immediately (button) or without undue delay (e-mail), and the User’s data is permanently deleted no later than within 14 days.
- The provider may terminate the contract with 14 days’ notice for important reasons, in particular when the service is discontinued. In case of a gross or persistent breach of these Terms or the law, the provider may block the Account with immediate effect, giving the User a statement of reasons.
- Before deleting the Account, the User should save any User Content they need. After deletion, User Content is removed as described in the Privacy Policy.
§ 5. Rules of use
- It is forbidden to provide unlawful content, in particular content infringing the rights of others, inciting violence, depicting child sexual abuse or containing malware.
- It is forbidden to send unsolicited commercial communications (spam) through Pisaczek, to attempt to circumvent security measures, to overload the system, or to use Pisaczek contrary to the law or good practice.
- A User of the messaging tools is responsible for having a legal basis to contact recipients, including any required consents.
§ 6. User Content and notices of illegal content
- User Content belongs to the User. The User grants the provider a non-exclusive, free licence only to the extent necessary to provide the services – storing, displaying, backing up and processing at the User’s request (e.g. by artificial intelligence tools). The licence ends when the content or the Account is deleted.
- Content the User chooses to publish (e.g. blog posts, shared answers, booking pages) is visible to others until withdrawn.
- Anyone can report content they consider illegal by writing to kontakt@pisaczek.pl. The notice should include a substantiated explanation, the exact location of the content (e.g. its address), the reporter’s contact details and a statement of good faith. The provider handles notices without undue delay and informs about its decision; a User whose content is restricted receives a statement of reasons and may appeal.
§ 7. Artificial intelligence
- Answers and actions of artificial intelligence tools are generated automatically and may contain errors. They are not medical, legal, financial or other professional advice. Important information should be verified before use.
- The Assistant acts only on the User’s instructions. Actions that cannot be undone (e.g. sending, publishing, permanent deletion) require the User’s approval.
- To generate an answer, the content of a request is sent to the artificial intelligence model providers listed in the Privacy Policy.
§ 8. Data entrusted by the User
- Where the User processes personal data of other people in Pisaczek (e.g. clients booking appointments, message recipients, chat participants), the User is the controller of that data and the provider processes it on the User’s behalf as a processor (Article 28 GDPR). By accepting these Terms, the User entrusts the provider with such processing on the terms below.
- The subject matter and purpose of processing is providing the Pisaczek services; processing lasts for the period of use; it concerns the data and categories of people that the User enters (usually contact details, appointment times, message content).
- The provider: processes the data only on the User’s documented instructions, which is the use of Pisaczek features; ensures confidentiality of authorised persons; applies appropriate security measures; assists the User with data subject requests and obligations under Articles 32–36 GDPR; deletes the data after the contract ends unless the law requires retention; makes available the information needed to demonstrate compliance and allows audits.
- The User gives general authorisation to use the sub-processors listed in the Privacy Policy. The provider informs in advance of intended changes and the User may object.
§ 9. Availability and liability
- The provider makes efforts to keep Pisaczek running continuously and securely and makes backups. Technical breaks are possible; where possible we announce them in advance.
- The provider is liable for the conformity of the digital service with the contract under consumer protection law. For Consumers, these Terms do not exclude or limit liability where the law does not allow it.
- Towards Users who are not Consumers, the provider is not liable for lost profits, and its liability for free services is limited to wilful misconduct.
§ 10. Complaints
- Complaints can be sent to kontakt@pisaczek.pl. Please describe the problem, the Account’s e-mail address and the expected solution.
- The provider replies within 14 days of receipt, in the same way the complaint was made unless the User indicates otherwise.
- Consumers may use out-of-court dispute resolution, in particular the help of municipal or district consumer ombudsmen, consumer organisations or the regional Trade Inspection. Information is available on the website of the Polish Office of Competition and Consumer Protection (UOKiK).
- Consumer provisions also apply to a natural person concluding a contract directly related to their business where the contract shows it is not of a professional nature for that person.
§ 11. Changes to the Terms and services
- The provider may change these Terms or the scope of services for important reasons, in particular changes in the law, changes in Pisaczek features, security reasons or a change of suppliers.
- The provider announces changes by e-mail or in Pisaczek at least 14 days before they take effect. A User who does not accept the changes may terminate the contract before they take effect.
§ 12. Final provisions
- These Terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection of mandatory provisions of the country of their habitual residence.
- Disputes are resolved by the court competent under general rules.
- The processing of personal data is described in the Privacy Policy.
- These Terms apply from 5 October 2026. The Polish version is binding.
